Employment Tribunal Fees Challenge - Funding Your Employment Law Claim

The UK's Court of Appeal has dismissed UNISON's appeal against the government's introduction of Employment Tribunal fees.

Since the introduction of the fees there has been a 70% drop in Employment Tribunal claims, many believe due to the fact that Claimants, who may have recently lost their job and source of income, are put off by the fees.

Lord Justice Underhill stated that in order for UNISON's challenge to be successful they must provide concrete evidence that the drop in Tribunal claims were down to the level of fees rather than a suspicion.  The Judge also dismissed additional arguments by UNISON regarding indirect discrimination and the public sector equality duty.
