No Win No Claims - What you need to know  Solicitors who work on No Win No Fee claims will charge a Success Fee. This is usually a percentage of the costs incurred. Although some of a Claimant's costs will be paid by the Defendant the Defendant is no longer liable to pay the success fee due to a change in the law.  The success fee is deducted from a Claimant's compensation at the end of the case, if the claim is successful. However, the solicitor will not charge a fee for their services if the claim does not succeed.   It is important to be aware that if you win your case the Defendant will usually pay your expenses, such as medical report fees, Court fees etc but if you do not win then you would be responsible for payment of those expenses yourself. This is why Claimants are usually advised to check whether they have pre-existing insurance in place that would cover them for those expenses. If not, then your solicitor can arrange 'After the Event' insurance for you.  In most cases the premium is only payable and is deducted from your compensation if your case succeeds. Your solicitor should be able to tell you what the premium will be before you decide whether you want to take it out.  We will only ever deduct a maximum of 25% from your compensation - this includes the success fee, any shortfall in costs between costs incurred and those recovered from the Defendant and VAT. However, the ATE premium is payable by you in addition if your claim succeeds.
