Employer's duty of care  
An employer has a duty of care to ensure the safety of their employees whilst at work. Your employer must provide:- 
 
A safe sytem of work and working practices. This includes whether suitable warnings or notices were in place warning of the danger or whether staff were trained to carry out the work.  
Safe premises and a safe working environment, for example an employer must ensure that floors and means of access are kept safer and free from obstacles which may cause a danger to employees. 
Safe plant, machinery, materials and equipment. An employer must provide safe plant and equipment and have proper systems in place to inspect, maintain and repair plant and machinery etc.  
 
If your employer has breached their duty of care, by not taking reasonable care, then they will be negligent.  
 
What can I claim for? 
In the vast majority of cases a Claimant will be unable to work for a substantial period of time and in cases involving very serious injuries it may not be possible to return to their job. In these cases a claim for loss of earnings (past and future) can be made as well as compensation for pain, suffering and loss of amenity. Other losses can include:

‘No Win, No Fee’ Accident Claims – Making a Compensation Claim 

Our personal injury solicitors operate on a ‘no win, no fee’ basis. That means that bringing a compensation claim is risk free and if you lose, it will not cost you anything. Your accident claim will only be handled by a fully qualified solicitor with the expertise so that you receive the best possible service and outcome. 
 
Do all solicitors charge the same success fee and is it worth shopping around? 
 
A success fee is based on the risk a solicitor takes in running any particular case - as you might imagine some cases are riskier than others and the success fee (which is based on a percentage of the costs) will reflect the level of risk.  
 
However, simply asking a solicitor what percentage they charge for their success fee will tell you nothing about how much they will deduct from your compensation at the end of the case. A solicitor who charges a success fee of 25% may deduct more from your compensation than one who charges a success fee of 40%.

No Win No Claims   Solicitors who work on No Win No Fee claims will charge a Success Fee. This is usually a percentage of the costs incurred. Although some of a Claimant's costs will be paid by the Defendant the Defendant is no longer liable to pay the success fee due to a change in the law.  The success fee is deducted from a Claimant's compensation at the end of the case, if the claim is successful. However, the solicitor will not charge a fee for their services if the claim does not succeed.   It is important to be aware that if you win your case the Defendant will usually pay your expenses, such as medical report fees, Court fees etc but if you do not win then you would be responsible for payment of those expenses yourself. This is why Claimants are usually advised to check whether they have pre-existing insurance in place that would cover them for those expenses. If not, then your solicitor can arrange 'After the Event' insurance for you. We can arrange insurance that provides that the premium is payable by you and is deducted from your compensation ONLY IF your case succeeds. No payment is required up-front. *  We will only ever deduct a maximum of 25% from your compensation for our costs - this includes the success fee and VAT. Note that a Defendant is not responsible for payment of all of your legal costs - usually only about 60 -70% (and sometimes less) is recoverable from the Defendant and so many solicitors will deduct the shortfall from their client's compensation.
